RTBU-PacNat Member's EBA 2005 Update Newsflash! 55

IMPORTANT DEVELOPMENT:

We have been advised that Pacific National have issued an Employee Update to the Coal Division AND Maintenance Division in regards to the Enterprise Agreement. The update includes a list of dates and times for employee briefing sessions prior to a vote on the Agreement. As a result, the RTBU advises all members the following:

  1. The RTBU has not yet received an electronic version of the proposed roll over Agreement, and as such, have not been able to forward the draft document to your negotiating team for review. It surprises the RTBU that the company is now stating that a copy of the document will be available on the company's website this week.
  2. There is no agreement in regards to dates and times for member / employee briefing sessions because the company has not provided your union with any information in regards to what the company is proposing. Whilst it is understood that briefing sessions will need to be conducted, we would have expected some prior advice as to the dates and times being proposed by the company to assess whether the RTBU was available to participate in the briefing sessions. Perhaps this is yet another example of the company's continued attempts to treat your union as a third party. It would appear that your union will need to conduct briefing sessions of its members separately to the company, and will do so prior to the vote.
  3. At present, there is STILL no final Deed of Agreement between the parties in regards to the further two roll overs.
  4. We are yet to finalise how the parties are to protect the current conditions / entitlements pertaining to the Driver Only Compendium, Relay Working Compendium and Local Agreements. The parties have agreed that they are to be protected, but there is no agreement in place as to how they will be protected.
  5. As a result of the meeting with the company last Friday, Pacific National was to advise the RTBU when they were available to meet next with a view to progressing and finalising these matters.

Members will be kept informed of any significant developments of the Enterprise Agreement as they occur. The RTBU will conduct a phone hook up of your campaign committee next Tuesday to discuss the status of the Enterprise Agreement and seek feedback.
